These Terms of Service ("Terms") govern your use of the website operated by Total Advantage Solutions LLC ("Total Advantage Solutions," "we," "us," or "our") located at totaladvantagecapital.com, our online forms, and any SMS/text messaging program we offer (collectively, the "Services"). By accessing the Services or opting in to receive text messages from us, you agree to these Terms.

1. About Us

2. No Loan Commitment

Information presented on this site, including product tiers, rates, LTV/LTC ratios, credit thresholds, and program details, is for general informational purposes and does not constitute a commitment to lend, an offer of credit, or a guarantee of any specific terms. All loans are subject to underwriting, appraisal, eligibility requirements, and lender approval, and may not be available in every state.

3. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services. By submitting a deal or contact request, you represent that the information you provide is accurate and that you are authorized to provide it.

4. SMS / Text Messaging Program Terms

By providing your mobile number to Total Advantage Solutions LLC and opting in (whether through a web form, paper form, verbal agreement, or by texting a keyword to our number), you consent to receive text messages from us at that number. The following terms apply to our SMS program:

  • Program description. Total Advantage Solutions LLC sends account-related and conversational SMS messages, including loan scenario follow-ups, document requests, status updates on submitted deals, appointment confirmations, and replies to your inquiries.
  • Message frequency. Message frequency varies based on your interaction with us. You may receive recurring messages.
  • Message and data rates. Message and data rates may apply. Check your mobile plan with your carrier for details.
  • Opt-out (STOP). You can cancel the SMS service at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a confirmation message and you will not receive any additional messages unless you opt back in.
  • Help (HELP). Reply HELP to any message for help, or contact us at 574-309-4149 or info@totaladvantagecapital.com.
  • Carriers. Carriers, including but not limited to AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket, and Google Voice, are not liable for delayed or undelivered messages.
  • Privacy. Mobile information (including phone numbers and SMS opt-in data) will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other categories of personal information are handled as described in our Privacy Policy.
  • Consent is not a condition of purchase. Your consent to receive SMS messages is not required as a condition of receiving any product or service from Total Advantage Solutions LLC.

5. Acceptable Use

You agree not to use the Services to submit false or misleading information, impersonate another person, interfere with the operation of the site, or violate any applicable law or regulation.

6. Third-Party Links

The Services may contain links to third-party websites, including our deal-intake form hosted on Google Forms and our affiliated insurance brand. We are not responsible for the content, policies, or practices of those third parties.

7. Intellectual Property

All content on the Services, including text, logos, and design elements, is owned by Total Advantage Solutions LLC or its licensors and is protected by applicable intellectual property laws.

8. Disclaimers and Limitation of Liability

The Services are provided "as is" without warranties of any kind. To the fullest extent permitted by law, Total Advantage Solutions LLC disclaims all warranties, express or implied, and will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

9. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in St. Joseph County, Indiana.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
